Zusammenfassung: Bei der Betreuung einer sechsjährigen Patientin für einen elektiven HNOEingriff ergab sich der Verdacht des sexuellen Missbrauchs. Zufällig waren vor der geplanten Gabe eines Paracetamol Suppositoriums auffällige anale und vaginale Dilatationen mit ringförmiger Narbenbildung gefunden worden.


Noch während der Narkose erfolgten die telefonische Befragung des niedergelassenen Kinderarztes sowie klinische Untersuchungen durch einen Kinderarzt und einen Rechtsmediziner. Im weiteren Verlauf wurde das Kind erneut inspiziert, erste Gespräche wurden mit der Mutter geführt. Letztendlich wurde der Fall vom zuständigen Jugendamt weiter verfolgt und nähere Ergebnisse nicht bekannt gegeben. Das interdisziplinäre Vorgehen bei der weiteren Verfolgung des Verdachts und der Betreuung der Patientin und ihrer Familie wird beschrieben. Typische Befunde und ihre Erhebung werden erläutert. Ferner wird das Potential für juristische und Gewissenskonflikte, das sich aus ärztlicher Schweigepflicht einerseits und der Abwehr bzw. Aufdeckung einer Straftat andererseits ergeben könnte, diskutiert.

Summary Summary: In a sixyearold girl undergoing elective tonsillectomy, suspicion of sexual abuse was raised incidentally when the child was to receive rectal paracetamol for postoperative analgesia. It was discovered that the anus and the vaginal vestibule were conspicuously dilated and rough and also marked by circular scars which were thought to be suggestive of repeated penetration. While the girl was still under anaesthesia, the family’s paediatrician was called and asked whether he had made any suspicious observations himself. In addition, the patient was examined by an experienced paediatrician and a forensic pathologist. On the next day, the girl was seen again by a paediatric surgeon. The mother was then informed in a first discussion about the results of the physical examination and the suspicion of abuse. Finally, responsibility for the care of the child was transferred to the relevant local authority. No details were provided on the girl’s further protection, however. The following article describes the interdisciplinary approach that has been taken to deal with this case of suspected child abuse. The psychological sequelae and physical findings of abuse are characterized and potential legal and moral conflicts of the physicians arising from the collision between the duty of medical confidentiality on the one hand and the commitment to disclose and prevent a criminal offence on the other are discussed.
