Zusammenfassung

Zusammenfassung: Die erste Novelle des 1998 in Kraft getretenen Transfusionsgesetzes (TFG) hat zum Ziel, die Umsetzung Europäischen Rechts in das Transfusionsgesetz und in arzneimittelrechtliche Vorschriften zu vollziehen. Dies betrifft sowohl Regelungen für die Blutspendeeinrichtungen und Blutdepots, Festlegungen von Qualitäts- und Sicherheitsstandards für Blut und Blutbestandteile sowie bestimmte Anforderungen für Blutstammzellen.


Darüber hinaus werden fachliche Einzelaspekte geregelt, die Klarstellungen sind oder neue Erkenntnisse darstellen. So enthält der Gesetzentwurf Klarstellungen der Begriffe „Spende" und „Spendeeinrichtung" und verdeutlicht die Funktion der ärztlichen Personen in den Spendeeinrichtungen. Bisher schon bestehende Meldepflichten werden präzisiert und ergänzt, darüber hinaus werden fachlich gebotene Erleichterungen für die Herstellung bestimmter Blutprodukte in der Zahnarztpraxis oder im Operationssaal (bestrahltes Wundblut) festgelegt.

Summary Summary: The aim of the first amendment of the transfusion act that came into effect in 1998 is to incorporate European law in the transfusion act and in legal drug regulations. This applies both to the regulations regarding blood donation facilities and blood depots, the establishment of quality and safety standards for blood and blood components, and certain demands to be met concerning blood stem cells. Over and beyond this, certain technical aspects are also regulated in the sense of clarifications or new information. The draft law thus contains clarifications of the terms donation and donation facility, and defines the function of the medical personnel in such donation facilities. The requirement for notification is defined more precisely and extended, while technically necessary facilitations for the production of certain blood products in the dentist`s office or the operating theatre (irradiated wound blood) are established. 2001;20:930-936.
